Visa Administrative Review

If a visa decision contains an error, administrative review may be available. It is a specific Home Office procedure, rather than a fresh application or an appeal to a judge. SJS can review the refusal and explain whether this is the appropriate way to challenge the decision.

Understanding your next steps

How we can help

Check the right to request a review

The decision letter should explain whether administrative review is available and the deadline. The rules differ according to the decision and where you applied. Send the whole letter and the date you received it, rather than only the final page.

Identify the alleged error

A review needs a clear explanation of the decision-making error. We compare the reasons given with the application and the evidence submitted. Simply disagreeing with the outcome or wishing to improve the original application may not be enough.

Consider the alternatives

A fresh application or another form of challenge may need consideration. Making a new application can affect a pending administrative review. We explain the implications before you take another immigration step or make travel arrangements.

A clear way forward

What happens next

  1. Send the original case file

Provide the decision, submitted form, supporting documents and correspondence, together with the date and method of notification.

  2. Review the reasons

We assess the available review grounds, the applicable evidence rules and any consequences for your current immigration position.

  3. Prepare the challenge

If instructed to proceed, we prepare a focused explanation of the errors identified and the supporting material allowed by the procedure.

Fees and timescales

Fees and costs

We will quote for reviewing the decision and, where appropriate, preparing the administrative review. The Home Office review fee and any translation costs are separate. Further work following the result may need a separate agreement.

Timing and preparation

Time limits are short and differ between circumstances. Contact us promptly after receiving the decision. A request for advice does not stop the deadline, and the review itself can take a substantial time to be decided.

Useful to know

Your questions, answered

Is administrative review the same as an appeal?

No. Administrative review asks the Home Office to reconsider specified decision-making errors. An appeal, where available, goes to an independent tribunal under a different procedure.

Can I send any new evidence I want?

The use of new evidence is restricted and depends on the relevant rules. We first check what was submitted and whether additional evidence can properly be considered.

Can I submit a new visa application while waiting?

A new application can cause the administrative review to be withdrawn or rejected. Get advice on the consequences before making another application.

Does every refusal qualify for administrative review?

No. Availability depends on the type of decision. The refusal letter and the applicable rules must be checked to identify the correct remedy and deadline.
